Removal of Conditional Status for Marriage
Do you have a 2-year conditional residence granted through marriage?
At Santiago Legal, we help you convert it into legal residency without conditions, even if you are separated or divorced.
¿Qué es una Residencia Condicional?
If you obtained your green card through marriage to a U.S. citizen or permanent resident, and you have been married for less than two years, USCIS will grant you a conditional green card valid for two years.
Before it expires, you must apply to have your conditional status removed to obtain permanent immigration status, or you could lose your right to live and work legally in the U.S.

How can we help you?
At Santiago Legal, we guide you through the entire process to ensure your immigration status is not affected. We assist you with:
Preparing and Submitting Form I-751
Advice on filing a case jointly with your spouse
Support in complicated cases, such as separation, divorce or situations of violence
Gathering evidence of good faith of the relationship
Legal strategies if you no longer have spousal support
Legal representation if your case goes to an interview with USCIS
The process is not automatic. You must act before your card expires, preferably within 90 days of the expiration date.

¿Qué pruebas necesitas?
Some key evidence to prove your marriage was legitimate:
Children in common
Joint tax returns
Shared bank accounts
Lease agreements or joint ownership
Family and travel photos
Testimonials from friends or family
Correspondence addressed to both
Don't you have much evidence or are you separated?
Don't worry. We'll analyze your situation and present a solid case, even with little evidence or without a spouse's signature.
Cases in which you can file without your partner
You can file Form I-751 without your spouse if:
You are divorced or legally separated
Your spouse was abusive or caused you emotional harm
The marriage was in good faith but ended for reasons beyond your control.
In these cases, you can request an exemption from the joint signature requirement.
At Santiago Legal, we know how to present these cases with care and legal sensitivity.

Is your conditional card about to expire and you don't know how to continue?
Don't jeopardize your legal status. At Santiago Legal, we speak Spanish, offer in-person or video consultation, and we work diligently to prepare your case.
